Paceline Canada and Quebec Addendum

This Canada and Quebec Addendum (“Addendum”) supplements the Paceline Terms of Service, Privacy Policy, Consumer Health Data Privacy Notice, Rewards Program Terms, Marketplace Terms and Refund Policy, and Cookie and Tracking Technologies Notice for residents of Canada. If there is a conflict between this Addendum and another Paceline policy, this Addendum controls for Canadian residents to the extent required by applicable Canadian law.
1. Canadian Consumer Rights
Nothing in Paceline’s terms or policies limits, excludes, modifies, or waives any rights, remedies, warranties, guarantees, or protections that cannot be limited, excluded, modified, or waived under applicable Canadian federal, provincial, or territorial law.
Any disclaimers, liability limitations, arbitration provisions, class-action waivers, governing-law clauses, venue clauses, return policies, cancellation policies, or program-change rights apply only to the maximum extent permitted by applicable Canadian law.
2. Eligibility and Age of Majority
Canadian residents may use the Service only if they are at least the age of majority in their province or territory of residence and legally capable of entering into binding agreements.
3. Privacy Officer and Accountability
Paceline is responsible for personal information under its control. Paceline has designated a Privacy Officer accountable for compliance with applicable privacy laws. 4. Consent for Sensitive Information
Paceline collects, uses, and discloses personal information with your knowledge and consent, except where otherwise permitted or required by law. Consent may be express or implied depending on the sensitivity of the information and the circumstances.
For sensitive information, including health, fitness, biometric, wearable-device, or precise geolocation data, Paceline obtains express consent where required. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal may limit Service functionality.
5. Limiting Collection, Use, Disclosure, and Retention
Paceline limits collection, use, and disclosure of personal information to purposes described in the Privacy Policy, this Addendum, and other applicable notices, or to purposes otherwise permitted by law. Paceline retains personal information only as long as reasonably necessary for identified purposes, legal obligations, dispute resolution, fraud prevention, enforcement, and business records.
6. Access, Correction, and Challenging Compliance
Canadian residents may request access to personal information Paceline holds about them and request correction if it is inaccurate or incomplete. Paceline will respond within timeframes required by applicable law.
If you have privacy concerns, contact Paceline’s Privacy Officer. If you are not satisfied with the response, you may contact the Office of the Privacy Commissioner of Canada or the applicable provincial privacy regulator.
7. Cross-Border Processing
Personal information may be stored or processed outside Canada, including in the United States. Information processed outside Canada may be subject to the laws of that jurisdiction and may be accessible to courts, law enforcement, or national security authorities. Paceline uses contractual and other safeguards designed to protect personal information transferred internationally.
8. CASL Marketing Communications
Paceline will send commercial electronic messages to Canadian recipients only with express or implied consent as permitted by CASL. Commercial electronic messages will include required sender identification information and an unsubscribe mechanism. You may unsubscribe by using the link in an email, replying STOP to SMS where available, or contacting us. Withdrawal of marketing consent does not affect transactional or service-related communications.
9. Promotions, Contests, and Rewards in Canada
Rewards, promotions, sweepstakes, contests, and similar offers may be subject to additional Canadian rules, eligibility requirements, mathematical skill-testing questions, Quebec restrictions, tax considerations, and sponsor terms. Paceline may limit or exclude participation where required to comply with law.
10. Governing Law and Disputes for Canadian Residents
California law and U.S. arbitration provisions in Paceline’s Terms apply only to the extent permitted by applicable Canadian law. Mandatory Canadian federal, provincial, or territorial laws may apply and will prevail to the extent required. Courts, tribunals, or regulators in Canada may have jurisdiction where mandatory law so provides.
