Consumer Health Data Privacy Policy

In this Consumer Health Data
Privacy Policy (“Policy”), we describe how Tam(squared) Inc., doing business as
Paceline (“Paceline,” “we,” “us,” or “our”) collects, uses, and discloses consumer
health data that is protected under the Washington My Health My Data Act and
the Nevada Consumer Health Data Privacy Law (collectively, “US State Consumer
Health Data Privacy Laws”) collected through our operations, provision of products, and websites (the “Services”). This Policy our main privacy policy available at https://paceline.fit/pages/privacy-policy.
This Policy does not apply to information or practices that are not subject to the US State Consumer Health Data Privacy Laws, such as publicly available information or job applicant and employee information. The terms in this Policy have the same meaning as under the applicable US State Consumer Health Data
Privacy Law.
We may change this Policy at any
time. If we make changes, we will post the latest version on our websites.
1. The Categories of Consumer Health Data We Collect
The data we collect depends on
the context of your interactions with Paceline and the data you allow your wearable device to share with us. We may collect the following categories of “consumer health data,” which means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status, subject to certain exceptions:
- Bodily functions, vital signs, symptoms, or
measurements of the information described in this Section 1; - Individual health conditions;
- Information processed to associate or identify a consumer with the data described above that is derived or extrapolated from
non-health information.
2. Purposes of Collection and How Paceline Uses Consumer Health Data
As described further in the How
We Use Your Information section of our main privacy policy, we may collect and use consumer health data for the purposes set forth below:
- Providing Services and support. To
communicate with you about your use of our Services; to provide our Services; to
respond to your inquiries; to facilitate your application for insurance products offered by our partners; and for technical and customer service purposes. - Analytics and improvement. To better
understand how users access and use our Services, products, and offerings, and
for other research and analytical purposes, such as to evaluate and improve our
Services and business operations; to develop and improve our Services and
features; and for internal quality control and training purposes. - Customization and personalization. To
tailor the content that we may send you and that we may display on our websites,
including to offer personalized fitness goals, help and instructions, and to
otherwise personalize your experience. - Marketing and advertising. For
example, to send you information about our Services, such as newsletters, and
other marketing content, including about third party products and services we
think may interest you, as well as any other information that you sign up to receive. - Research and Analysis. To analyze user
behaviors, including users’ fitness and consumer purchasing activities, to
improve the Services and our reward offerings and reward incentives; to conduct
research and analysis and monitor and analyze trends and usage, including in
conjunction with our partners. - Security and protection of rights. To
protect our rights and our business operations; to prevent and detect fraud,
unauthorized activities and access, and other misuse; to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our privacy policies or statements. - Legal proceedings and obligations. To
comply with the law and our legal obligations; to respond to legal process and
related legal proceedings. - General business and operational support. To consider and implement mergers, acquisitions, reorganizations, financings, bankruptcies, and other business transactions; for activities related to the administration of our general business, such as accounting, auditing, compliance, recordkeeping, and legal functions.
3. The Categories of Sources From Which We Collect Consumer Health Data
In general, we may collect consumer health data from the following categories of sources:
- Directly from you;
- From your devices;
- Our business partners;
- Publicly available sources;
4. The Categories of Consumer Health Data That We Share
We may share the categories of consumer health data described above under The Categories of Consumer Health Data We Collect section. Specifically, we may share consumer health data with your consent or as reasonably necessary, to provide Services you have requested or authorized. For example, if you choose to participate in a research or related program with our insurance partners, we may share this information with these partners.
5. The Categories of Third Parties and Specific Affiliates with Whom We Share Consumer Health Data
Paceline may share the categories
of consumer health data included in Section 4 with the following categories of
third parties and specific affiliates:
- Business partners, including insurance providers;
- Vendors and other processors that assist us with business operations;
- Operating systems and platforms;
- Parties to litigation and others as required by law;
- Third parties we, our affiliates, or subsidiaries are or may be acquired by, merged with, financed by, or invested in by another company, or if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected about you to the other company. We may also share certain personal information as necessary prior to the completion of such a transaction or corporate transactions such as financings or restructurings, to lenders, auditors, and other advisors, including attorneys and consultants, as part of due diligence or as necessary to plan for a transaction.
6. Your Privacy Rights
You have the following rights under the applicable US State Consumer Health Data Privacy Law, subject to applicable exceptions:
- Know/Access: The right to confirm whether
we collect, share, or sell your consumer health data and the right to access
such consumer health data; - Withdraw consent: The right to withdraw
consent from our collection and sharing of your consumer health data; and - Deletion: The right to have your consumer
health data deleted.
Exercising Your Privacy Rights
To exercise your rights, please
email us at opt-out-ca@paceline.fit. Before completing your request, we may need to verify your identity or your authority to make a request on behalf of another person. We may request additional documentation or information solely for the purpose of verifying your identity, depending on the type of your request.
If we deny your request to exercise a
right, you can appeal our decision by sending an email to opt-out-ca@paceline.fit with the subject line “APPEAL.” If your appeal is unsuccessful, you can file a complaint
with:

7. Changes to this Policy
We may make changes to this Policy from time to time. When we do, we will post the updated version on this page. We encourage you to read this page each time that you use our services so that you will be aware of any changes, and your continued use of our services shall constitute your acceptance of any such changes. Changes to this Policy
take effect from the date of publication, unless stated otherwise.
